Allow for civil action to collect certain delinquent property taxes

    Senators Barrett and Malek,

    Missoula County supports HB 516 – Allow for civil action to collect certain delinquent property taxes, being heard in Senate Taxation tomorrow morning. HB 516 provides an additional tool to address delinquent taxes when the state of the property prevents the county from using the normal collection method of property tax deed. Missoula County has struggled with one large industrial tax payer who has refused to pay back taxes. There have been no parties willing to take tax deed due to the unknown nature of potential clean up requirements for the property. HB 516 would allow counties and other taxing entities to use the civil court process to pursue the delinquent taxes. Missoula County believes a small amendment to clarify that counties may act on behalf of all taxing jurisdictions, or barring county action, the taxing jurisdictions may act on their own accord.
