Missoula County opposes HB 319 – Provide process for designating roads as public – in House Local Government. HB 319 allows for a petition process by any 10 land owners in a county, adjacent to the road or not, to petition for a road to become a public road. HB 319 creates a positive presumption that a road is public road and places the burden of proof on those objecting to the public road designation, potentially leading to the last supplied legal remedy of filing in district court. Existing statute already provides a clear and effective process for making a road public.
