Require timelines for review of a final subdivision plat

    Representative Hertz,

    Missoula County requests that HB 245 - Require timelines for review of a final subdivision plat, be amended. HB 245 is being heard before House Local Government this afternoon. Final plat review involves multiple entities to complete a legal review prior to obtaining commissioners' signatures, including the Health Department, Surveyor, Public Works, Planning, and others. Complex subdivisions may take longer than the 15 day limit, as proposed in HB 245. An amendment to reflect a longer timeline has been requested by our Planning division.
    Please consider amending HB 245.

    Representative Curdy: I want to clarify our stand on HB 245. Missoula County has several concerns with the bill but our message yesterday focused on page 1 line 28 of the bill which requires that within 15 days of receipt of the final plat the governing body must determine if the plat conforms. Missoula County is concerned that the allotted 15 days is not enough time for staff to complete the review of the final plat for major subdivisions. As you know subdivisions vary in complexity and in the case of large subdivisions the amount of information that needs to be reviewed can be extensive. I thought this was the number of days you referred to. I hope this clarifies our position. Apologies for the confusion.
