Missoula County Supports SB 15 – Revise collection of payment for historic right of way, before Senate Natural Resources this afternoon.
Historic Rights of Way present unique challenges to counties when attempting to determine legal access. Current law requires that the full appraised value of the land be obtained, as though the property was being sold, when in fact only an easement interest is sought. SB 15 addresses this issue by allowing DNRC to obtain appraisals for the easement interest only, which better serves the state and local governments.
