  1. MACDC has chosen to remain neutral at this time but will appear as an informational witness to address the need for coordination instruction on the bill to deal with the potential conflict with the clerk’s bill SB123. There may also be a few minor issues to bring to the committee’s attention.

  2. MACDC will testify as an opponent at the hearing in House Human Resources. Section 2 adds language to duties of the Clerk & Recorder when it should be added to statutes pertaining the duties of the Clerk of District Court. Because of SB123, there needs to be coordination language to direct what happens to SB123 if SB375 passes. Clerks also prefer a standard Declaration of Marriage form be drafted for use by couples in order to ensure hat couples provide all information required under §40-1-311, MCA.
