Missoula County opposes SB 262 - Revise laws governing public road access, on the Senate floor today. SB 262 does not further define "nondesignated road" or "right-of-way" which can lead to subjective conditions where any road that appears to meet the conditions necessary to quality for a perspective easement may be considered. The procedure for designating a right-of-way would also be problematic and costly if local government must reimburse the applicant for expenses incurred to provide the documentation required to show that the right-of-way is private.
