Missoula County opposes SB 98 – Establish property fairness act, before the Senate floor this afternoon. SB 98 would make essentially all state and local regulation a regulatory taking of private property with compensation due from the local and state government. This would include conditions on subdivision applications, floodplain regulations, zoning, county special districts and easements. Even minor administrative actions, like county road maintenance, would have to be evaluated to decide whether or not the action would constitute a taking of private property. If a takings is proven, the county would pay the loss in property value to the owner or would have to forego that action. Even the act of repealing regulations might be a takings, as that act may impact the value of properties.
