Remove mandatory jail for driving on suspended or revoked license

    Senators Fielder and Sands,

    Missoula County strongly supports SB 90 – Remove mandatory jail for driving on suspended or revoked license, before Senate Judiciary this morning. The current mandatory two days in jail on a first offense driving while suspended leads to a large percentage of people cited and ultimately asking for a public defender, creating bottlenecks in the court system. In comparison, a first offense for a DUI offense comes with a mandatory 24 hours in jail. SB 90 further assists Missoula County in its efforts to address jail overcrowding, especially for non-violent offenders.
